Market supervision departments at all levels have thoroughly implemented the decision-making arrangements made by the CPC Central Committee and the State Council, strictly enforced the People’s Republic of China (PRC) Anti-Food Waste Law, made stopping food waste an important part of food safety supervision, actively created a social atmosphere of "wasting is shameful and saving is proud", actively discouraged food waste, corrected and investigated many illegal acts of food producers and operators in accordance with the law, and now announced the second batch of typical cases.
1. The Market Supervision Administration of Panyu District, Guangzhou City, Guangdong Province investigated and dealt with the case that Nakamura Meiji Snack Bar and Nakamura Zhangyujun Restaurant failed to take measures to prevent food waste.
On November 4-5, 2022, law enforcement officers of Panyu District Market Supervision Administration, Guangzhou, Guangdong Province, found in their daily inspections that the Meiji Snack Bar in Zhongcun, Panyu District, Guangzhou and the Zhangyujun Restaurant in Zhongcun, Panyu District, Guangzhou did not post or place anti-food waste signs in conspicuous places in their business premises, and the parties concerned violated the provisions of Article 7 of People’s Republic of China (PRC) Anti-food Waste Law and Item (2) of Paragraph 1 of Article 11 of Guangzhou Anti-food Waste Regulations. On December 7-8, 2022, law enforcement officers found that the parties concerned had not rectified the above-mentioned illegal acts. According to Article 25 of the Regulations on Anti-Food Waste in Guangzhou, Panyu District Market Supervision Administration of Guangzhou, Guangdong Province imposed administrative penalties of fines on Meiji Snack Bar in Zhongcun, Panyu District, Guangzhou and Zhangyujun Restaurant in Zhongcun, Panyu District, Guangzhou respectively.
2. The Market Supervision Administration of Yilong County, Nanchong City, Sichuan Province investigated and dealt with the case that Bawangzi Waiwocai Restaurant induced and misled consumers to order too much food.
On January 3, 2023, the Market Supervision Administration of Yilong County, Nanchong City, Sichuan Province received complaints from the masses that the Bawangzi Waipocai Restaurant in Xinzheng Town, Yilong County was suspected of inducing and misleading consumers to order too much. After on-site inspection, law enforcement officers found that the parties did have illegal acts in the process of selling dishes, which induced and misled consumers to order too much food and caused food waste. Law enforcement officers ordered the parties to immediately rectify and give a warning. On January 6, 2023, law enforcement officers found that the parties still induced and misled consumers to order too much food. The party concerned violated the provisions of Article 7 of the Anti-Food Waste Law of People’s Republic of China (PRC), and the Market Supervision and Administration Bureau of Yilong County, Nanchong City, Sichuan Province imposed an administrative penalty of 2,000 yuan on Bawangzi Waiwaicai Restaurant according to Article 28 of the Anti-Food Waste Law of People’s Republic of China (PRC).
Third, the Market Supervision Administration of Wuxi Economic Development Zone in Jiangsu Province corrected the case of Shuiyun Hotel inducing consumers to order too much food.
On November 15, 2022, the Market Supervision Administration of Economic Development Zone in Wuxi City, Jiangsu Province inspected the Shuiyun Hotel in Economic Development Zone, and found that there were many dishes left after the guests finished eating in the hall, and the parties did not take the initiative to remind consumers, resulting in food waste. Law enforcement officers ordered it to correct immediately on the spot. On November 23, 2022, the Economic Development Zone Market Supervision Administration re-examined the hotel and found that the parties still induced and misled consumers to order too much food, resulting in a large number of dishes left after the consumers finished eating. The party concerned violated Article 7 of the Anti-Food Waste Law of People’s Republic of China (PRC), and according to Article 28 of the Anti-Food Waste Law of People’s Republic of China (PRC), the Market Supervision Administration of Economic Development Zone of Wuxi City, Jiangsu Province imposed an administrative penalty of fine 1000 yuan on Shuiyun Hotel according to law.
4. The jin an district Market Supervision Administration of Lu ‘an City investigated and dealt with the case that Longfeng Hotel did not guide consumers to order food as needed to prevent food waste.
On December 1, 2022, jin an district Market Supervision Administration of Lu ‘an City, Anhui Province conducted an on-site inspection of Longfeng Hotel in Zhangdian Town, jin an district City, Lu ‘an City according to the complaints of the masses, and found that the parties used the opportunity of arranging dishes for consumers to induce consumers to order more food. On the spot, law enforcement officers issued a notice to the parties to order correction, demanding that the illegal acts be corrected immediately, and warned and punished on the spot. On December 8, 2022, the bureau received another complaint from the masses. After investigation, the complainant originally planned to book a banquet package of 588 yuan/table in the client’s store. After repeated persuasion by the staff of Longfeng Hotel, the complainant was induced to finally buy a banquet package of 788 yuan/table, which caused a lot of waste of dishes. The party concerned violated the relevant provisions of the second paragraph of Article 7 of the Anti-Food Waste Law of People’s Republic of China (PRC), and the jin an district Market Supervision Administration of Lu ‘an City, Anhui Province imposed an administrative penalty of fine 1000 yuan on Longfeng Hotel according to Article 28 of the Anti-Food Waste Law of People’s Republic of China (PRC).
5. The zhijiang city Municipal Market Supervision Administration investigated and dealt with the case that Parrot Hotel did not take measures to prevent food waste.
On December 1st, 2022, during the special law enforcement inspection of anti-food waste, zhijiang city Municipal Market Supervision Administration found that the old parrot hotel in Dongshi Town, zhijiang city did not post or place anti-food waste signs in its business premises, and did not take the initiative to remind consumers to prevent food waste, resulting in obvious food waste. On the spot, law enforcement officers ordered the parties to immediately correct the illegal acts and gave warnings and punishments. On January 31, 2023, when law enforcement officers reviewed the parties, they found that the parties had not corrected the above illegal acts. The party concerned violated the provisions of Item (2) of Paragraph 1 of Article 7 of People’s Republic of China (PRC) Anti-Food Waste Law, and the zhijiang city Municipal Market Supervision Administration of Hubei Province filed an investigation on the illegal acts of Parrot Hotel according to law, and planned to impose administrative punishment according to Article 28 of People’s Republic of China (PRC) Anti-Food Waste Law.
